Hyundai - False Advertising of Miles Per Gallon (MPG)
After receiving complaints from Hyundai owners across the country, in November, 2011 Consumer Watchdog challenged the US Environmental Protection Agency to audit Hyundai over the "40 Miles Per Gallon" MPG claims on the window sticker of its Elantra. On November 2, 2012, the EPA confirmed Consumer Watchdog's allegations, announcing that Hyundai and KIA would be required to change the false MPG window sticker claims on many of their vehicles, including Elantra.
Consumer Watchdog is calling for Congressional hearings on the matter and is prosecuting lawsuits on behalf of Hyundai owners who were misled.

February 20, 2013 - First Court Hearing on National Class Actions Against Hyundai/Kia
On February 14, Federal District Court Judge George H. Wu held an initial hearing on class action lawsuits filed against Hyundai and Kia across the country for falsifying gas mileage estimates. The purpose of the hearing was to establish a schedule for the litigation. At the hearing, however, a lawyer in one of the lawsuits against Hyundai announced that he had already reached a settlement with the companies. The Consumer Watchdog legal team asked for more information on this unexpected development.
January 31, 2013 - Federal Court Panel Hears Consumer Watchdog Request to Transfer All Other Hyundai Mileage Lawsuits to Federal Court in Southern California
A special panel of federal judges meeting in Orlando, Florida held a hearing today on a request by Consumer Watchdog's lawyers to centralize, in a Southern California federal court, all lawsuits related to Hyundai’s misrepresentation of vehicle mileage. In addition to a lawsuit brought on behalf of Hyundai owners by a team of nationally recognized lawyers assembled by Consumer Watchdog, more than thirty similar lawsuits have been filed across the country. A decision is expected within a few weeks.
November 29, 2012 - Senator Rockefeller Asks Hyundai CEO For Answers
United States Senator and Commerce Committee Chairman John D. Rockefeller writes the president and chief executive of Hyundai Motors America to answer questions about the company’s false “Mile Per Gallon” window sticker claims that were exposed by an Environmental Protection Agency audit.
November 19, 2012 - Consumer Watchdog Requests Congressional Hearing on Hyundai-MPG Scandal
Consumer Watchdog sends a letter calling upon leaders of the House and Senate Commerce committees to hold hearings into the revelation by the EPA that for the first time in American history large numbers of vehicles carried window stickers with false MPG claims.
November 19, 2012 - Consumer Watchdog Asks Federal Courts to Transfer All Cases to Central District of California
Consumer Watchdog attorneys and co-counsel Cotchett, Pitre & McCarthy, LLP, Cuneo Gilbert & LaDuca, LLP and Dreyer Babich Buccola Wood Campora, LLP file a request with the United States Judicial Panel on Multidistrict Litigation to transfer and consolidate all related Hyundai and Kia MPG cases in a single district court in Southern California. The request to centralize the litigation was filed in response to reports of numerous similar lawsuits filed across the nation.
November 6, 2012 - Federal Lawsuit Filed by Consumer Watchdog Legal Team
Consumer Watchdog attorneys and a team of highly respected private firms representing Gunther Krauth and other Hyundai owners file suit against Hyundai in federal court in California. The case is Krauth et al. v. Hyundai Motor America, U.S. District Court for the Central District of California, Case No. SACV12-01935 AG (ANx)
November 2, 2012 – EPA Announces Hyundai Overstated MPG
The Environmental Protection Agency (“EPA”) announces that an audit of fuel economy data provided by consumers and Hyundai to the EPA showed that Hyundai overstated fuel economy for the 2011-2013 Elantra and other vehicles. The EPA action confirmed Consumer Watchdog's allegation that the cars displayed a window sticker with false information concerning the fuel efficiency of the vehicle, and its advertising based on those inflated values was patently false.
July 3, 2012 – California Lawsuit Filed by Consumer Watchdog Legal Team
Consumer Watchdog attorneys and a team of private law firms file suit against Hyundai on behalf of Hyundai vehicle owners in Sacramento, California Superior Court. The case is Louis Bird et al. v Hyundai Motor America, Sacramento Superior Court, Case No. 34-2012-00127249
April 23, 2012 – Consumer Watchdog Legal Team Demands Hyundai Address Inflated MPG Charges
Consumer Watchdog and co-counsel Cuneo Gilbert & LaDuca, send a letter to Hyundai Executive Vice President and General Counsel, Jerry Flannery, pursuant to the Consumer Legal Remedies Act (California Civil Code § 1750 et seq.).
February 1, 2012 – Consumer Watchdog Letter to Hyundai Execs
Consumer Watchdog sends a follow up letter to Hyundai Motor Company’s Seoul-based President, Eok Jo Kim, and Hyundai US CEO Krafcik, seeking clarification after a copy of a Super Bowl advertisement appeared on Hyundai's YouTube page without the “40 MPG Elantra” claim on screen, but with the “40 MPG Elantra” claim made on the YouTube side bar. On February 2, 2012, Hyundai confirmed to Consumer Watchdog that it would not include its “40 MPG Elantra” claim in its 2012 Super Bowl advertisement. Hyundai contended, however, it was not influenced by Consumer Watchdog and continued its pervasive use of its 40 MPG advertising.
January 12, 2012 – Consumer Watchdog Asks White House to Step In
Consumer Watchdog sends a letter to President Obama (and EPA Administrator Jackson) requesting that the President require the EPA to conduct new automobile fuel economy testing, rather than continue to allow automobile manufacturers to self-test and report fuel economy numbers, and also to reevaluate its testing procedures.
December 14, 2011 – Consumer Watchdog Demands Hyundai Action
Consumer Watchdog sends a letter to Hyundai Motor America CEO John Krafcik, noting the disappointment of Elantra customers and stating, “[s]ince, like other automakers, you largely conduct your own EPA MPG testing and report it to the agency, you should be joining Consumer Watchdog in urging the EPA to independently re-test the Elantra to confirm or correct Hyundai’s testing.” Consumer Watchdog also requested that Hyundai correct their advertising including any advertising that might appear in the prime Super Bowl spots they purchased: “We also urge you to remove or qualify your prominent MPG claims in your holiday advertising until re-testing validates or disputes Hyundai’s tests.”
November 30, 2011– Consumer Watchdog Urges EPA to Act
Acting in response to numerous complaints from Hyundai owners, Consumer Watchdog sends a letter to top officials at the US Environmental Protection Agency, including Administrator Lisa Jackson, Director Margo T. Oge of the Office of Transportation and Air Quality, and Deputy Director Chris Grundler of the National Vehicle and Emissions Laboratory. Consumer Watchdog specifically requests “that the EPA re-test the 2011 and 2012 Elantra model in its own facility, to seek an explanation for the MPG disappointments of so many Elantra buyers….”
