SHIP changes to its claim procedures to ensure policyholders receive home care benefits

Case Status:
Completed

William Hall v. Senior Health Insurance Company of Pennsylvania, San Bernardino Superior Court Case No. CIVRS 1200996

Consumer Watchdog and Shernoff, Bidart Echeverria Bentley LLP settled a lawsuit against long-term care insurer Senior Health Insurance Company of Pennsylvania (also known as SHIP) in September 2012.

Under the settlement agreement, SHIP will make changes to its claim procedures and claim forms to ensure California policyholders receive the home care benefits to which they are entitled under their SHIP policies.

The lawsuit, filed in February 2012 in San Bernardino Superior Court, challenged SHIP’s company-wide business practices, which the suit said were designed to avoid providing home care benefits to elderly and infirm policyholders.

The plaintiff in the lawsuit, Dr. William Hall of Upland, California, was a former U.S Army colonel who earned a Purple Heart in the Korean War and the former Chief of Medicine at a California hospital.
